Legal basis considered
Swiss Federal Data Protection Act – FADP/DSG (SR 235.1), in force since 1 September 2023.
Ordinance on Data Protection – DPO/DSV (SR 235.11), where applicable.
Federal Act against Unfair Competition – UCA/UWG (SR 241).
Swiss Code of Obligations – CO/OR (SR 220), insofar as it applies to contractual relationships.
Price Indication Ordinance – PIO/PBV (SR 942.211), where offers or advertising containing prices are directed at consumers.
Guidelines of the Federal Data Protection and Information Commissioner (FDPIC/EDÖB) on transparency, cookies, outsourcing, international transfers and security breaches.
1. Purpose and acceptance
These Terms govern access to and use of Expo Innovation Online by visitors, users and other persons browsing the website expo-onlinech.com. By using the platform, the user declares that they are aware of these Terms to the extent legally applicable.
2. Nature of Expo Innovation Online
Expo Innovation Online is a platform for promoting companies, products, services, promotions and vouchers. Its main function is to increase visibility and connect users with advertising companies.
Unless expressly stated otherwise, Expo Innovation Online is not the manufacturer, importer, seller, provider of the advertised service, carrier or payment agent for any purchase made between the user and the advertiser.
3. Establishment of the commercial relationship
When a user decides to purchase a product or contract a service advertised on the platform, the commercial relationship is established directly with the advertiser. The user must check the terms of the offer, price, availability, delivery, payment, exchanges, returns and warranty directly with the advertiser.
4. Advertiser’s responsibility
The advertiser is responsible for photographs, videos, descriptions, features, prices, discounts, the validity of promotions, stock, availability, the legality of the product or service, payment methods charged to the consumer, delivery, service provision, exchanges, returns, warranty and after-sales service.
5. Vouchers and promotions
The vouchers and promotions advertised may be subject to time limits, quantity, geographical area, terms of use and restrictions set by the advertiser. The advertiser is responsible for honouring the published conditions and communicating any changes in an appropriate manner.
6. Prices
Where advertisements are aimed at consumers and mention prices, advertisers must comply with the applicable Swiss rules on transparency and price indication. Expo Innovation Online may request corrections or remove advertisements that appear to contain misleading or incomplete pricing information.
7. Content and intellectual property
Expo Innovation Online’s own content is protected by applicable legislation. Advertisers declare that they hold the rights to the materials they supply. Users may not reproduce content from the platform for commercial purposes without authorisation, except where permitted by law.
8. Prohibited use
It is prohibited to use the platform for fraud, manipulation, abusive scraping, technical attacks, the introduction of malicious code, infringement of third-party rights or any illegal activity.
9. Platform availability
Expo Innovation Online will endeavour to keep the platform available, but does not guarantee uninterrupted operation. Maintenance, technical faults or temporary downtime may occur.
10. Third-party links and websites
The platform may redirect users to advertisers’ websites, WhatsApp, social media platforms or payment pages. From that point onwards, the terms and policies of the relevant third party shall also apply.
11. Complaints regarding products and services
Complaints regarding quality, payment to the advertiser, delivery, exchanges, returns or guarantees should be addressed directly to the advertiser. Expo Innovation Online may provide a channel for reporting issues with advertisements and take moderation measures where appropriate.
12. Limitation of liability
To the extent permitted by Swiss law, Expo Innovation Online shall not be liable for any breach of obligations that fall exclusively to the advertiser. This clause does not exclude liability for wilful misconduct, gross negligence or other liabilities whose exclusion is prohibited by law.
13. Suspension and removal
Expo Innovation Online may suspend content or access where there are indications of fraud, illegality, a breach of these Terms, a security risk or a need to protect users and third parties.
14. Data protection
The processing of personal data is governed by the Privacy Policy and, where applicable, by the Cookies Policy.
15. Amendments to the Terms
Expo Innovation Online may update these Terms where necessary. Significant amendments shall be communicated in an appropriate manner where they affect ongoing relationships.
16. Governing law and jurisdiction
Unless otherwise required by mandatory provisions, Swiss substantive law shall apply. The determination of the competent court shall be governed by the applicable mandatory Swiss rules; this clause is not intended to exclude mandatory legal jurisdiction.
Final provisions
No provision of this document shall be construed as excluding any rights or liabilities that cannot be validly excluded under applicable Swiss law.
Expo Innovation Online may update this document in the event of relevant legal, technical or operational changes. The current version shall remain available at expo-onlinech.com.
